PermisLux Terms of Use
1. Purpose
These Terms of Use (the “Terms”) govern access to and use of the PermisLux mobile application (the “App”) operated by PermisLux (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms.
2. Eligibility
PermisLux is designed for individuals preparing for the Luxembourg driving theory exam. If you are under the age of 16, you must obtain consent from a parent or legal guardian before using the App.
3. User Account
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- We reserve the right to suspend or terminate accounts in case of misconduct, misuse, or violation of these Terms.
4. Content and Information
- Questions, explanations, and media in the App are curated from public and educational sources relevant to Luxembourg.
- Information is provided for guidance only; official SNCA publications remain the authoritative reference for the exam.
- Any unauthorized reproduction, distribution, or use of the App’s content is strictly prohibited.
5. Pricing and Purchases
Certain features may be free, while others require a subscription or in-app purchase. Pricing, payment methods, and renewal terms are detailed within the App and on official store listings (App Store / Google Play). Purchases are processed by the respective platforms according to their own terms and policies.
6. Pass Guarantee (Money-Back Guarantee)
Certain PermisLux subscription plans, clearly marked as such at checkout, include an optional "Pass Guarantee." This guarantee is subject to all of the following conditions:
- Eligibility. The Pass Guarantee applies only to subscriptions explicitly marked with this option at the time of purchase. It is personal to the account holder: only the individual who purchased the subscription may request a refund under this guarantee.
- Mandatory proof of full completion. To be eligible for a refund, you must have completed 100% of the modules and sub-modules available in the App for your selected permit category before sitting the official SNCA theory exam. Partial completion does not qualify. Completion is verified exclusively through the App's own records, visible to you at any time via Settings > Show Progress, which lists every module and sub-module together with the date and time you completed it. We may request a screenshot or export of this Progress screen as part of your claim.
- Exam window. You must sit the official SNCA theory exam within 30 days of first activating the subscription associated with the Pass Guarantee.
- Proof of failure. If you fail the official exam, you must submit a refund request within 7 days of the exam date, including: (i) your Show Progress screen confirming completion of all modules/sub-modules, (ii) an official document from SNCA (or the relevant exam center) confirming the failed result, and (iii) proof of your latest subscription payment.
- Refund amount. If your claim is approved, we will refund the latest subscription payment associated with the Pass Guarantee. If a discounted or promotional rate was paid, the refund reflects the amount actually paid, not the standard price.
- Exclusions. The Pass Guarantee does not apply if: the App's progress records show incomplete modules or sub-modules; the exam was taken more than 30 days after subscription activation; the refund request is submitted more than 7 days after the exam; the subscription was not marked as including the Pass Guarantee at checkout; or the request is submitted by someone other than the original purchaser.
- To submit a claim, contact us at contact@permislux.lu with the required documents listed above. We reserve the right to verify eligibility and to update or discontinue the Pass Guarantee at any time; changes will not affect subscriptions already covered by an active guarantee at the time of the change.
7. Sponsorship and Promotions
PermisLux may display sponsored messages or promotional content from selected partners, such as Luxembourg driving schools. These communications remain limited and clearly labeled.
7. Intellectual Property
All elements of the App (text, graphics, logos, code, databases) are protected by Luxembourg and international intellectual property laws. No ownership rights are transferred to you. Unauthorized use is strictly prohibited.
8. Availability and Support
We strive to keep the App available at all times. However, temporary interruptions may occur for maintenance, updates, or unforeseen events. For technical issues, please contact us at contact@permislux.lu.
9. Liability
- The App is provided “as is”. We cannot guarantee error-free content or absolute suitability for your specific needs.
- We are not liable for any consequences arising from inaccuracies or from failing the driving exam.
- We are not responsible for indirect or intangible damages resulting from App usage.
10. Personal Data
Use of the App involves the processing of personal data. For more information, please refer to our Privacy Policy.
11. Changes to the Terms
We may update these Terms at any time to reflect legal, technical, or functional changes to the App. Continued use after changes are communicated constitutes acceptance of the updated Terms.
12. Governing Law and Jurisdiction
These Terms are governed by Luxembourg law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Luxembourg City, subject to mandatory consumer protections.
